school and basketball training camp in roseville. we can show you its facebook page. here is the person who is facing these allegations. this is a college prep boarding school with an emphasis on having a high quality elite basketball program. it only got started last fall by this guy. he's the man police are investigating. police say a 15-year-old, a 20 year old from france, both are from france and 17 year old from brazil and another student from the sacramento area claim they were forced to stand in a corner restrained with zip ties and sometimes had clothes pins clamped on their nipples as a form of punishment. the teacher says he's innocent and will be exonerated. >> you look at my players, 6'6", 6'7", 6'5", 200 and some pounds. there's no way one of those

players would let me do anything to them at that level. >> he was arrested on suspicion of child abuse involving corporal punishment and willful cruelty, battery and false imprisonment. he's been released on $100,000 bail. roseville police are expanding their investigation including a search for more potential victims. a vigil being held tonight for an off-duty san mateo county sheriff's deputy was who killed while riding his motorcycle. he died last week when a car turned right in front of him while riding his motorcycle in burlingame. he had that car and later died at the hospital. police say the driver did not see her out there and she was not arrested. the 51 year old leaves behind a wife and a 12-year-old son. tonight's vigil will be held at 6:00 in millbrae. it's 5:03.

police need your help finding one of the men involved in a violent south bay home invasion. investigators say a man resembling this sketch beat up an elderly woman and her daughter when they caught him and his accomplice trying to break into their car. they assaulted the 74-year-old mother. the woman escaped to a nearby home and police say the man ransacked that house and then took off. police have not released the description of the second suspect. some california cities right now battling the state over medical marijuana. for the very first time, the state supreme court is getting involved. the court hearing arguments today on whether local governments can ban medical marijuana dispensaries even though it's legal at the state level. "today in the bay's" christie smith is live at the court building in san francisco this morning and no doubt a lot of people paying attention to this one. >> reporter: that's right. good morning to you. you can bet dispensaries up and

down the state will pay close attention to what happens here in san francisco today. right now about 200 cities and counties in california have some sort of limitation or ban in place. as you said, for the first time the state supreme court is going to weigh in on whether local governments actually have a right to go ahead and ban pot dispensaries within their borders. california voters legalized medical marijuana in 1996 but since then more bay area cities are limiting pot clubs or banning them all together. medical marijuana advocates believe the state laws allow for some limitations but not outlawing them all together. >> there are regulations already set up and already guidelines around it and i just feel like i think everybody that should be able to do it that wants to do it. >> reporter: about three dozen bay area cities have some sort of limitation or ban in place. the argument come out of riverside where a city used zoning laws to ban storefront

marijuana shops and one sued the city to try to stop the closure. we spoke with one who wants cities to have the final say in this. we'll hear from him coming up in about 30 minutes. reporting live in san francisco, christie smith, "today in the bay." it is 5:05. after much controversy and debate, richmond city council will swear in a new councilmember later today. there was almost five hours of debate last night over who, which of the 12 candidates would fill the seat currently held by gary bell in the hospital in a coma. last night the council selected a 27 year old who currently works for assembly woman nancy skinner. let's get a check on the tuesday forecast. christina loren is here. enjoying a lot of nice temperatures outside. chilly today. >> chilly and cloudy as well. nothing like yesterday. temperatures are going to be pretty nice. not too bad. you don't have to worry about

2014 winter games in russia. >> to get us in the olympic spirit, we have bob redell and told him to go hit the ice. he joins us live from the san jose ice center this morning with one of the more unusual sports of the game. good morning, bob. >> reporter: which is a sport that certainly has become more popular in recent years. good morning to you there, jon and laura. we're already talking about 2014 winter olympic games. here we are exactly one year out. this is san jose ice. bay area curling club that's become popular in recent years. right now they have roughly 150 members. i've got colleen and richard here. one thing that surprised me is that you have so many people here in the bay area interested and yet no one from here is going to the olympics. is that correct? >> that is correct. we have people who want to try. there's clubs in the midwest and they have dedicated ice and play all the time.

we get to play once a week. it's going to take work. we'll get there eventually. there are other olympics coming up. >> every sport has a different level of competition. what is the difference between someone who is just on the brink of qualifying and then people who do qualify? would a lay person be able to tell the difference in terms of how that person performs? >> a lay person might because you see someone making more shots than someone who just started. everyone started the same way. come out the first time. throw the first stone and you practice and learn and you keep playing and try to get better and hopefully you make it up to that if that's what you want to get to that level. >> reporter: one thing you haven't seen since we're in an off olympic year is a drop in membership. you have actually maintained. >> that's true. in olympic cycles with crazy winter sports that everyone only sees once every four years, you have your olympic peak and then a valley for the next four years while membership drops off. somehow curling popularity went crazy in the last few years. the bay area it's become so popular that we're selling out

welcome back. good tuesday morning to you. 5:13. business leaders preparing to meet with the president over immigration. scott mcgrew joins us now. some progress for silicon valley. >> the valley has been pushing for all kinds of new visas to keep educated talented workers here. yahoo! ceo marissa mayer one of the representatives of high tech along with former aol chief will meet with the president as well and the president will meet with the labor side of the equation today. not always as supportive of bringing new workers in the american workforce. the president's state of the union speech is one week from today. immigration expected to be a central theme. to the other kind of visa, san francisco based visa credit card company reports profits today. you get double data out of visa. not only do we get a picture of

how the company is doing, it shows how much the consumer is spending because visa gets a cut of every transaction. so happy visa data is happy consumer spending data. we talked a bit yesterday about how the stock market might have gotten ahead of the economy a little bit. apparently the stock market was listening. dow suffered the biggest loss of the year so far yesterday. let's look ahead to today. courtney reagan is live at cnbc world headquarters. good morning, courtney. >> hi. good morning to you, scott. futures are higher this morning. that's good news like you mentioned socks suffered the worst loss of the year on monday. investors sold off shares amid new worries about europe particularly what's going on with the debt crisis in spain and italy. today we'll get information on the services sector and earnings from kellogg's and disney. the dow dropped 129 points to 13,880. the nasdaq lost nearly 48 points to 3131. scott, back to you.

staying cool though with that cold air trailing behind the front. that will bring us showers on thursday. 5:17. let's see what he's tracking. hi, mike. >> tracking the tractor right here. this is where we had shown construction going on and closure for the off-ramp 880 at stevens creek. you see the parking lot for macy's there. the lights are now off. the tractor stopped moving and the lady or gentleman who was driving it now looks like they have left the off-ramps are open again and construction has wrapped up for the day. 280 and 880 through that corridor you'll have construction going on through the rest of the week and we'll be sure to let you know because that's an unusual set of on and off ramps to be closed for overnight road work. over here we're looking at a smooth drive for the peninsula 101 and 280. right there dumbarton bridge eastbound toward the fremont and newark side you do have that road crew blocking one lane. not a major issue. a smooth flow of traffic. light volume to the east bay. 880 moves smoothly moving past

the old plant. slowing shows up but no incidents heading north into union city. we'll continue to track that. your tri-valley is a smooth flow of traffic and traditional build. increase for 580. 680 not a problem. livermore construction eastbound. earlier slowing cleared here but altamont pass is showing more activity. more cars coming into the area at the start of your commute. bay bridge, also shows a good start for your commute. no backup for the cash lanes or fastrak. east shore freeway easy drive and san rafael a smooth drive for the north bay shot as well. look at that. easy. back to you. the time now is 5:19. and roaches, rats and rotting food not appetizing but things you often hear when media reports on restaurant inspections. our investigative unit goes behind dirty restaurants to expose a system that's failing diners here in silicon valley. we're joined now with the

undercover investigation. >> counties across the bay area score restaurants based on results of health inspections, you would never know just how kitchens in santa clara county fared because there's no grading system. so we went undercover. what we found, restaurants violating a state law and no one enforcing it allowing secrets to cook behind the kitchen door. >> reporter: state law requires all restaurants keep a copy of the most recent inspection report on hand. if you asked to see it, they have to show it to you. he's the manager of this deny ns in sunnyvale. documents show it was shut down in late 2011 for a large amount of roaches and inspectors found more roaches living at denny's

just last summer. the most recent inspection reveals four violations but remember he wouldn't show us that report. but even denny's has to follow the law. our investigation found many restaurants violating. >> reporter: is this acceptable? >> it is not. >> reporter: we followed up with denny's who sent thus statement. the policy is to provide the most recent health inspection report upon request as and mated by state law. we're reminding all restaurants in california of this policy. coming up tonight, watch as we go undercover as more restaurants in silicon valley where some employees told us to leave and others didn't share the truth. we'll also show you other ways to get inspection information

welcome back, everyone, on a tuesday morning bright and early. a live picture of the bay bridge. very beautiful in the early darkness there. the sun soon to come up. christina loren will tell us about a day that will shape up to be a nice one. mike has your roads. it is 5:24. and right now a major scandal being revealed following reports the world's most watched sports may be rigged. a new inquiry by a european police intelligence agency says a 19-month investigation reveals

widespread cheating in soccer matches. this inquiry finds 680 soccer matches were in fact fixed including some of those world cup qualifier games. nearly $3 million in bribes were handed out either to players or on-field officials. they have never seen match fixing activity on this scale ever before. the investigation covers matches from 2008 to 2011. 5:24. santa clara officials say a super bowl power outage like the one in new orleans would never happen at the new 49ers stadium. santa clara stadium is on the short list to host super bowl l in 2016. after the power outage in the superdome, electrical utilities will be a consideration for the next host city. the nfl will choose the host city in may. >> a major issue down there.

your peninsula drive coming up. >> let's take a live look outside over by sfo. looks like traffic is moving smoothly. we'll check in with that guru, mike inouye. it's tuesday, february 5th. this is "today in the bay." it is almost 5:30. good morning. thank you for getting up with us. i'm jon kelley. >> i'm laura garcia-cannon. new this morning, santa clara police hope surveillance video from an overnight robbery will lead them closer to suspects. robbers held up the shell station along great america parkway not too far from the theme park. luckily no one was hurt but police have not said how much money was taken. the robber drove off in a white car heading off toward highway 237. we expect to learn more today from police about a deadly crash on a oakland street all caught on camera. we want to warn you some of this video may be disturbing. a surveillance camera capturing

this head-on crash at 36th avenue and foothill boulevard. one person died in this crash. somehow three other people including a person standing right on that corner escaped and managed to get away with only minor injuries. neighbors say people speed through that intersection and it's not the first time something bad has happened. >> it's the fourth major accident i have seen right here in six months. it happens all of the time right here. people go through here, 50, 60 miles an hour. i've got three little kids. i walk them back and forth here all the time. it's pretty scary. >> the owner of that jeep tells nbc bay area he was working on his vehicle in front of his house and he then went inside for a moment when a woman came up and stole it. she's the one that ended up crashing head-on into that honda. police expected to release more details of this investigation sometime later today. 5:31. the fight over medical marijuana heads to the state supreme court today. at issue whether local governments can ban dispensaries

within their jurisdiction even though pot clubs are legal at the state level. "today in the bay's" christie smith joins us live at the court building in san francisco with more on the story. good morning, christie. >> reporter: good morning to you, laura. medical marijuana advocates up and down the state are w5atchin this one closely. many feel if the state decides in favor of local government it would undermine the will of california voters who approved medical marijuana way back in 1996. more and more bay area cities seem to be limiting pot clubs or trying to ban them all together. about three dozen bay area cities are doing this. now today the state supreme court will decide whether cities can legally restrict them or not. san jose city councilman says he supports limiting the number of dispensaries but wants city to have the final say. >> it's disconcerting if the state rules that cities don't have the ability to control when and how and where dispensaries

operate. that's very important for a lot of communities because we know there are a lot of impacts of dispensaries. not all of them are good. >> reporter: right now about 200 cities and counties in california have some sort of ban in place. this case today actually comes out of riverside where the city used zoning powers to ban storefront marriaijuana shops. one sued the city to try to stop them from shutting them down. seven justices will hear this case this morning at 11:00. reporting live in san francisco, christie smith, "today in the bay." the san jose city council will take on the issue of marriage equality today. several council members are expected to request the council put a resolution supporting marriage equality on a future agenda. they also call on the city to join a case currently before the u.s. supreme court. that is aimed at overturning the defense of marriage act. they will not receive the mayor's support, however. in a recent interview, the mayor

said he supports civil unions and domestic partnerships, he draws the line at marriage. police near sacramento today expanding the search looking for more students who have been violently punished at an exclusive basketball academy. "today in the bay's" marla tellez is in the newsroom working on the story all morning long with details of the alleged abuse and what's being done to the teacher at the center of these allegations. >> reporter: not much is being done to the 24 year old. he is a free man since posting $100,000 bail. he is facing some very serious charges. we do have fresh video into our newsroom talking to our nbc station in sacramento. he was arrested in january after four of his ten students told police he would restrain them with zip ties for long periods of time and attach clothes pins to their nipples as a form of punishment. now he's the ceo and president of the ccse preparatory academy in roseville run out of this home. he started the college prep

boarding school, which has an emphasis on elite basketball training only last fall. most students are from overseas. on the school's facebook page, it says tuition is $10,000. $5,000 for boarding. he's adamant he'll be exonerated. >> if making sure they're doing school work and ensuring that they get great food and ensuring that they are safe and have a great place to live, if that's abusing kids, then i would say, yes, i did. i haven't abused any kids. >> he also says his accusers are the same students who recently learned they are being let go from the school. roseville police say three of the four are teens and he's facing child abuse charges including cruel corporate punishment and willful cruelty, battery and false imprisonment. police in roseville are expanding their search and believe there are more victims

out there. jon and laura? >> thank you very much for that update. >> let's get updated on the forecast with meteorologist christina loren. >> good morning to you. a live look at san jose. you can appreciate the fog once in a while. once in a while. it's iconic for the bay area. we don't want it every day. this morning is a different scenario that what we were dealing with yesterday because the fog was right at the surface reducing visibility to a quarter mile or less. this morning we're doing better at the surface. thick, low clouds hovering over the bay area. low ceilings this morning. that will limit the sunshine for the first part of the day. make sure you're ready for that. temperatures today on the cool side once we get rid of this fog only climbing into the mid 50s in some cities. so want to warn you about that. we hold off on the rain until thursday. hold off on the umbrella until that point. we'll have your full forecast in just a few minutes. let's look at your drive. >> i have turned our camera in palo alto to the north so we're looking at the taillights away

from us heading up in toward san mateo and traffic flowing past that willow avenue off-ramp. no problems southbound with headlights equally flight flow of traffic. let me show you the map for the area as well. we'll look at the dumbarton bridge eastbound direction of 84 with the road crew going on just for another half hour until they start to move those guys. no problems here all of the way up into san francisco or southbound which may be more of a commute later on in the day. we do have construction on the north side of the golden gate bridge. keep that in mind. typical crews there. mass transit also a smooth flow of traffic on the rails and on the roads. b.a.r.t., muni, vta, south bay valley transit authority moving on schedule. b.a.r.t. says 42 trains no delays. good stuff into and out of san francisco. and we'll get another look outside. a live look at the oakland area northbound 880 past the coliseum picking up a few cars southbound side same but still at the limit for the nimitz. back to you. >> thank you very much. it's 5:37. the faa might soon allow boeing to start test flights of the

welcome back. keeping your kids safe no matter what sport they play is a discussion taking place in washington. one of the first questions out of the box, what's the big focus of this meeting? >> the focus is 2 million injuries for young people every single year because teachers and parents and coaches and students themselves aren't always on the lookout for symptoms of these injuries so what this alliance wants to do for youth sports safety alliance working with national athletic trainers association have a student bill

of rights they're going to introduce today and the national plan for sports safety. they want to look at things like neurological injuries, concussions, head injuries, heart attacks, the environment, diet and substance abuse. all of this contributing to the 30,000 students being hospitalized every single year. one of the other things they want to look closely at are quality doctors available when students are hurt on the field or on the court. some states like california require students with possible concussions to be taken out and not put back in the game until there's a medical clearance. others don't. here on capitol hill they've been trying to come up with guidelines that all states can use but they have yet to do that. >> great study there hall of famer ronnie lott on yesterday and says he's for this. how many training is there for students and what to look out for? >> that's a good question. one of the things they're trying to do here is to get students to recognize when they are injured. a lot of times these kids don't want to come out of the game and

sometimes they don't realize how badly hurt they are. there is a lot of push in these high school sports particularly and sometimes they mistake pain for injuries and trying to get them to distinguish between the two. >> great studies. great program here. tracie potts, thank you for that information. this week marking a one-year countdown. a big countdown to the start of the 2014 games in sochi, russia. >> one of the sports featured is curling. we're also expecting pollen levels to creep down. a lot of people sneezing and sniffling. allergy levels are high. first, let's check your drive on a traffic tuesday. good morning, mike. >> it is traffic tuesday. here's the first burst we see about quarter to 6:00. north 101 at 680. here's what it plays out on the map. we see slowing north of 101 and 280/680 interchange. we took a look with the camera. slowing will clear up in the next ten minutes and come back at 6:15. rest of the northbound routes close to the limit and commute starting to build in many spots and that's why we focus on this north 87 to north 280 as you come through downtown. that connector ramp is closed. another 10 to 15 minutes before the crew clears. no major issues. if you travel through there past children's discovery museum get off one of the downtown exits and loop around and get on north 280 from southbound side of 87. easy work around but allow an extra three to five minutes for

sunnyvale for the equivalent of $2.66 an hour. now that would be a serious allegation against any company but this is really a special company. bloom was an absolute media and investor sweetheart back in 2010 when it was subject of a gushing "60 minutes" report and then this highly produced investors meeting you just saw showing off this technology. bloom makes fuel cells at the time promoted as the future of energy production. a u.s. federal judge has ordered bloom to pay workers wages they deserve under minimum wage laws. bloom energy had no comment on the accusations. other news, the computer company dell could go private today. going private is super easy. expensive. buy up all of the shares out there and microsoft, silver lake partners, michael dell himself may do just that. the markets calling for a better day after the worst drop so far this year in monday's trading.
